PROCEDURE OF THE AUCTION


In addition to the cataloged books, there will be approximately 1,000 books from which books may be selected for auction to start at an opening bid of $2.00. These requested books are to be placed on tables near the podium. If you cannot attend the full auction session, we will be glad to auction your requested books during the first half hour. We will auction the requested books during the first half-hour followed by the numbered catalog. At the end of the cataloged books, the remaining requested books will be auctioned.

 

CONDITIONS OF SALE

1. All books are cloth and 8vo unless stated.

2. All bids are to be per lot as numbered in the catalogue.

3. All property is sold "AS IS", and any representation or statement by the auctioneer in any catalogue, brochure or advertisement as to the authorship, attribution, genuineness, origin, date, age, provenance, condition or estimated selling price is a statement of opinion only. Every person interested should exercise and rely on his own judgment as to such matters and neither the auctioneer nor his agents are responsible for the correctness of such opinions.

4. Notwithstanding the preceding condition, property may be returned by the purchaser, the sale rescinded and the purchase reduced under the following conditions: 1. printed books, which prove upon collation to be defective in text or illustrations (provided such defects are not indicated in the catalogue or at the sale) 2. autographs & photographs are not authentic (if not indicated in the catalog or at the sale). Written notice, by registered mail return receipt requested, of the cause for return must be received by P & B Books within fourteen (14) days of the sale of the property, and the property must be returned to P & B Books in the same condition as it was at the time of the sale. BOOKS IN LOTS ARE NOT SUBJECT TO RETURN FOR ANY REASON.

5. On the fall of the Auctioneer's hammer, title to the offered lot will pass to the highest acknowledged bidder unless the lot did not meet a reserved price, who thereupon immediately assumes full risk and responsibility thereof, and will immediately pay the full purchase price thereof. No lot may be taken away unless the purchase price thereof has been paid in full.

6. The highest bidder acknowledged by the auctioneer shall be the purchaser. In the event of any dispute between bidders, the auctioneer shall have absolute discretion either to determine the successful bidder, or to re-offer and resell the lot in dispute. If any dispute arises after the sale, P & B Books sale records shall be conclusive as to the purchaser, amount on the highest bid, and in all other respects.

7. P & B Books reserves the right to withdraw any property at any time before its actual final sale, and to refuse any bid from any bidder. The Auctioneer is the sole judge as to the amount to be advanced by each succeeding bid.

8. The highest acknowledged bid shall be increased by a BUYER'S PREMIUM OF 10% OF THE BID. The sum of the bid and the premium shall be the purchase price payable by the buyer. Unless exempted by law from the payment thereof. The purchaser will be required to pay Connecticut Sales Tax

9. Bids which are submitted to P & B Books in writing, or are otherwise left with P & B Books prior to an auction for execution at or below a specific price, are entertained and executed by P & B Books for the convenience of bidders, but P & B Books shall not be responsible for failing to execute such bids, or for errors relating to the execution of such bids.

10. Payment for purchases must be made in cash or approved check, in US dollars drawn on a United States bank account. Upon receipt, P & B Books will, if so requested, ship purchases at an additional charge for handling, postage and insurance, but will not be responsible for any loss or damage resulting from the packing and shipping thereof. Unless specified, P & B Books is the sole judge in the method to be used for shipping. No items will be shipped until payment is received in full.


11. Reserves on lots are denoted with an asterisk (*). If the reserve is not met, the lot will not be sold.
